Termsof Use

1. Agreement

TouchTally is provided by FightTech (“FightTech”, “we”, “us”). By downloading or using TouchTally, you agree to these Terms of Use and to the terms of the store you got it from:

• if you downloaded TouchTally from the App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”);
• if you downloaded TouchTally from Google Play, the Google Play Terms of Service.

These terms add to those. For App Store downloads, if anything in these terms conflicts with the Standard EULA, the Standard EULA prevails. If you don’t agree, please don’t use TouchTally.

2. What TouchTally does

TouchTally uses your phone’s camera — and, for jump rope, optionally the microphone — to count soccer juggling touches and exercise reps on your device. It shows live stats, replays sessions, keeps records, and exports videos, images and data you can share. It has no account.

3. Training, health and safety

TouchTally is a training counter, not a medical device and not medical advice.

• Counts, form scores, rhythm and other figures are estimates and can be wrong, especially in low light or when you or the ball leave the frame. Estimated active energy saved to Apple Health is an approximation.
• Exercise involves risk. Warm up, train within your limits and stop if you feel pain or dizziness. Ask a doctor before starting a new exercise program if you have a health condition.
• Choose a safe place to train, away from roads, windows, breakable things and other people, and put your phone where a ball won’t hit it. We’re not responsible for damage to your phone or surroundings.
• Children should train with a parent or guardian’s permission and supervision.
• Only film other people with their agreement, and a parent or guardian’s agreement for children.

4. Your data

Your sessions, videos and records are stored on your phone, and you are responsible for them. Because we don’t hold a copy, we can’t restore them if you delete the app or lose your phone. How we handle information is described in our Privacy Policy.

5. Free and Pro

TouchTally is free to download. The free version includes juggling, jump rope, push-ups and squats (and, on iPhone, dribbling, volley keep-ups, racket bounces and shuttle keep-ups), live counting, replay of your latest session, the last 7 days of history, personal bests and challenges, and a result image with a small watermark. TouchTally Pro adds jumping jacks and plank (and, on iPhone, shooting, vertical jump and court footwork, plus dribbling counted on Apple Watch), full history with replay and count editing for every session, video and data export, and coaching features. Pro is available as:

• Yearly — US$24.99 per year, with a 7-day free trial for eligible users.
• Monthly — US$3.99 per month.
• Lifetime — US$49.99, a one-time purchase that doesn’t renew.

If Pro ends, your sessions and records aren’t deleted. Prices can differ by country or region. The store shows the price in your local currency, which may include taxes.

6. Subscriptions, trials and billing

• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the same price and period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• You can manage or cancel subscriptions at any time in your App Store or Google Play account settings. Cancelling stops future renewals; you keep Pro until the end of the period you’ve paid for.
• If you start the 7-day free trial, the yearly subscription begins and is charged when the trial ends, unless you cancel at least 24 hours before then. Trial eligibility is determined by the store.
• Purchases are tied to your Apple ID or Google account and can be restored on devices signed in to the same account.
• Payments and refunds are handled by Apple or Google under their terms. For App Store purchases, you can request a refund at reportaproblem.apple.com. For Google Play purchases, see Google Play’s refund help.

7. Acceptable use

Use TouchTally only for lawful purposes and as allowed by the store terms above. Don’t use it to film people without their agreement. Don’t attempt to copy, modify, reverse-engineer or redistribute the app, or to get around its purchase or security features, except where the law expressly allows it.

8. Disclaimer and limitation of liability

TouchTally is provided “as is” and “as available”. We work to make it accurate and reliable, but we don’t promise that it will be error-free or uninterrupted, or that its counts and stats will be correct. To the fullest extent permitted by law, FightTech is not liable for any indirect or consequential loss, or for injury or damage arising from training while using TouchTally. Nothing in these terms limits any rights you have under consumer protection laws that cannot be limited by agreement.

9. Changes

We may update TouchTally and these terms from time to time. When we change these terms, we’ll update the effective date above, and for significant changes we’ll give notice on this page or in the app. If you keep using TouchTally after changes take effect, you accept the updated terms.

10. Governing law

These terms are governed by the laws of Vietnam, without affecting any mandatory consumer protections that apply where you live.
